The court made a decision on the claim for the destruction of the highlight of the “house of herbalists” in Saratov

The regional cultural heritage committee filed a lawsuit against the administration of the Volzhsky district of Saratov regarding changes in the appearance of a cultural heritage site. The application was considered by the Arbitration Court of the Saratov Region.

We are talking about the “Residential House of the Saratov herbalists, the Sokolov brothers, with a fence,” located on Voznesenskaya, 33. It was included in the OKN list in 2022. This monument was especially notable for the unusual shape of the windows on the main facade and their complex glazing. In the spring of 2023, it became known that the original frames had been replaced with plastic ones.

The case file states that “filling window openings” was an object of protection. The administration of the Volzhsky district sued the resident of the apartment who replaced the windows, but the Volzhsky district court found that she was not to blame because she was not aware that the frames were subject to protection.

In the arbitration court, officials of the district administration argued that they also were not aware of the uniqueness of the windows, did not receive a protective obligation, and did not know about the inclusion of the “herbalists’ house” in the OKN list. The court rejected this argument because the administration sent a letter to the cultural heritage committee in April 2023, in which it called house No. 33 on Voznesenskaya Street a cultural heritage site.

The Arbitration Court of the Saratov Region ordered the administration of the Volzhsky District to ensure the development of design documentation for recreating the historical appearance of window fillings within 180 days, and within 360 days to organize work to restore the original appearance of the windows.

The authorities filed an appeal against this decision to the Twelfth Arbitration Court of Appeal. A hearing in the case is scheduled for May 20.
