The Northern District Court of Orel considered a civil case of damage to crops eaten by goats

The man filed a lawsuit against his neighbor for an obligation to perform an action and to recover the material damage caused. In support of the claims, he indicated that he and the defendant are the owners of a residential building and a plot of land, which are divided into two parts and each of them has a separate entrance, fenced around the perimeter. On August 18 last year, a man discovered that all the crops grown on his plot of land had been destroyed. In this regard, he filed a statement with the police. During the inspection, it was found that the neighbor’s goats had eaten the crop.

This case was not an isolated one; the goats repeatedly spoiled the harvest because the neighbor left them unattended. The man also repeatedly asked his neighbor to move the accumulation of goat manure from his fence, since in the summer it gives off an unpleasant odor and also attracts a large number of insects. But the woman decided to ignore the requests.

In court, the plaintiff asked to oblige the defendant to move the compost mound at a distance of 1 meter from his fence, to recover from her the amount of material damage caused in the amount of 60,000 rubles, to recover the costs of paying the state duty and the costs of paying for the services of a representative. During the trial, the man denied material damage. By the way, the woman never appeared in court.

The press service of the Northern District Court reports that after considering the dispute that arose, the court satisfied the plaintiff’s demands. He collected from the defendant the costs of paying for the services of a representative and the cost of paying the state fee in the total amount of 8,800 rubles, and also ordered the defendant to move the accumulation of compost in the form of a mound of goat manure to a distance of 1 meter from the plaintiff’s fence.
