A resident of Buryatia filed a claim with the Russian Ministry of Finance in the Gusinoozersky City Court. He asked to recover compensation for moral damage in the form of rehabilitation for prosecution in a criminal case under Part 1 of Article 335 of the Criminal Code of the Russian Federation (violation of the statutory rules of relations between military personnel in the absence of a relationship of subordination between them) and Part 1 of Article 119 of the Criminal Code of the Russian Federation (threat of murder or causing grievous bodily harm).

By cassation ruling, the Supreme Court of Russia overturned the conviction and all subsequent decisions. The criminal case was dropped and the right to rehabilitation was recognized.

“An illegal and unfounded accusation, a conviction for committing crimes that he did not commit, and the choice of a preventive measure in the form of a recognizance not to leave, limiting his life activities, caused moral harm,” the message says.

The court partially satisfied the claim. The Ministry of Finance was awarded compensation for moral damage in the amount of 300 thousand rubles.
