The privatization of a bomb shelter was canceled by the regional court in Voronezh

The Judicial Collegium for Civil Cases satisfied the claim of the Federal Property Management Agency to return the civil defense protective structure to state ownership, the press service of the Voronezh Regional Court reported on April 26. Previously, the Federal Property Management Agency was refused by the Kalacheevsky District Court.

The territorial department of the Federal Agency for State Property Management filed a claim with the Kalacheevsky court, demanding the removal from someone else’s illegal possession of an object located in the city of Kalacha and which is a protective civil defense structure. The owners of this shelter on the right of common shared ownership are three local residents.

On February 2, the district court rejected the claim from the Federal Property Management Agency. Subsequently, the department appealed to the appellate court.

But here things took a completely different turn. The regional court found that the disputed object was included in the number of protective structures for the civil defense of the Russian Federation. At the time of the transactions for its alienation, the property had the status of an active civil defense structure and was ready to receive citizens who needed shelter from danger.

This kind of object, the regional court concluded, is subject to a direct legislative ban regarding their privatization. Therefore, the shelter could not be transferred into ownership to the residents of Kalach.
