In the Tula region, a woman sued an individual entrepreneur for money for a low-quality jacket

The court granted the claim for a refund for goods of inadequate quality. In the Tula region, a consumer entered into a retail purchase and sale agreement with an entrepreneur for a women’s jacket for 7,990 rubles. But after three months, while wearing the jacket, shortcomings appeared, namely: abrasion of pigment from the surface of the skin.

The woman took the low-quality jacket to the store for evaluation and to determine whether or not the product was defective.

The consumer was presented with a conclusion issued by GlavExpert LLC (Moscow) that the genuine leather product had a defect of a non-manufacturing nature, with which the consumer did not agree, and therefore a claim was presented to the defendant demanding a refund for defective product. The entrepreneur refused.

The consumer contacted the Novomoskovsk territorial department with an application for assistance in restoring his rights in court. During the trial, an examination of the goods was carried out and it was determined that the goods were of inadequate quality.

The magistrate of the judicial district No. 13 of the Donsky judicial district made a decision in absentia to collect money from the individual entrepreneur in favor of the woman in the amount of 15,740 rubles, including a fine for failure to comply with the voluntary procedure for satisfying consumer demands in the amount of 4,913 rubles.
