The court satisfied the claim of the Federal Tax Service against one of the IKEA legal entities for 12.9 billion rubles

INTERFAX.RU – The Arbitration Court of the Moscow Region on Thursday upheld the claim of the MI of the Federal Tax Service of Russia for the largest taxpayers No. 1 against Torg LLC (one of the legal entities of IKEA, formerly Ikea Torg LLC) to invalidate the transaction for the transfer of funds to Torg LLC. to Fami Limited (Ireland) in the amount of 12.9 billion rubles, as well as the application of the consequences of invalidity of the transaction.

“The claim is satisfied in full,” says the information on the court’s website.

Details of the case have not yet been published.

On March 7, the court granted the tax authority’s application to take interim measures on the claim.

In particular, the court arrested the property of Torg LLC, including funds in the amount of 12.9 billion rubles, “with the exception of funds intended to pay wages to employees of Torg LLC, other payments related to labor relations, payment taxes, fees, penalties, fines and other payments to the budget provided for by tax legislation, administrative fines.”

The Federal Tax Service justified the application for taking security measures by the fact that “failure to take measures to secure the claim may complicate or make it impossible to enforce the court decision.”

On March 18, the court refused to cancel the security measures.

The Federal Tax Service refers to the fact that LLC Torg is part of the IKEA group of companies, which has suspended the operation of stores in Russia, LLC Torg does not sell goods, according to the tax return (calculation) for corporate income tax for 9 months of 2023 LLC “Torg” declared losses in the amount of 1,540,642,152 rubles, vehicles are being sold, the staff has been significantly reduced, which indicates that failure to take interim measures will make it impossible to execute the judicial act if the claims are satisfied.

The lawsuit was filed on January 30, 2024.

IKEA suspended operations in the Russian Federation in March 2022. Torg LLC belongs to the Ingka group (owns IKEA). For 2022, the legal entity received revenue in the amount of 38 billion rubles, a net loss of almost 2 billion rubles.
