The arbitration court of the Tambov region is challenging the order of the regional Ministry of Fuel and Energy and Housing and Communal Services on the possibility of concluding a concession agreement for the construction and operation of a waste treatment and disposal complex. The document, adopted in November 2023, requires that an organization that owns several waste treatment and disposal facilities in the Tambov region be declared illegal. The preliminary meeting took place at the end of March, the next one is scheduled for May 22.
On November 13 last year, the Minister of Fuel and Energy Complex and Housing and Communal Services of the Tambov Region, Elena Babikova, signed an order that actually launched the process of selecting an organization that will build and operate the main regional waste treatment facility, including a large landfill for waste disposal. An organization created in 2022, EcoTechnoPark Tambov LLC, which is a subsidiary of the Tambov Network Company, approached the ministry with such a proposal.
It is JSC “TSK” that, starting from 2019, plans to build a facility – the eco-technopark “Central”, which will receive the majority of all regional waste. Its cost will be about 3 billion rubles, and it should be located on the territory of the Sosnovsky district. It was assumed that the eco-technopark would start operating on January 1, 2023, but its construction has not yet begun.
According to the plaintiff, the contested order contains a number of serious violations of the law, which actually made it impossible for any other organizations to participate in the competition other than the one that took the initiative to conclude a concession. At the same time, we are talking about the compensation of costs for the construction of the eco-technopark provided for in the concession agreement at the expense of the regional budget in the amount of more than 2.4 billion rubles.
Since the Russian Ecological Operator, subordinate to the Russian Ministry of Natural Resources, was declared one of the participants in financing the construction of the eco-technopark, the court attracted this government agency to participate in the case. Now PPK “Russian environmental operator“and the Government of the Tambov Region will have to assess the risks of financing the construction of an eco-technopark from budget funds before the completion of legal proceedings.
Let us recall that in the Tambov region there is already a sad experience of constructing a waste disposal site in the Nikiforovsky district with the participation of the Tambov Grid Company, which now must, at its own expense, demolish the facility, which was built in violation of the law.
